Dividing fences between neighbours

In Western Australia, neighbours generally share the cost of building or repairing a sufficient dividing fence equally. Exceptions include damage caused by one owner, or by a natural disaster such as a storm, fire, flood or falling tree.

  1. Give your neighbour a written notice that states the boundary, the type of work, the material and colour, who arranges the work and how costs are shared.
  2. Sign it and deliver it in person or by registered post.
  3. For repairs, a neighbour has 14 days to object in writing. For a disagreement about a new fence, either owner can apply to court within 21 days of the notice being received.

Old fibro fences and asbestos

Old fibro sheeting can contain asbestos. Do not cut, drill, sand or break it. WA allows homeowners to remove up to 10 m² of non-friable asbestos cement without a licence, but WorkSafe strongly recommends a licensed removalist, and the waste must go to a licensed disposal facility.
